On Friday, Justice Richard Danyliuk admitted evidence gathered in a “Mr. Big” sting operation into the Greg Fertuck murder trial.
Fertuck was charged with the first-degree murder of his wife Sheree Fertuck in June of 2019.
The trial has been delayed multiple times and has even seen the departure of Fertuck’s lawyers. Fertuck is currently representing himself in court.
Friday’s decision allows evidence gathered by police during a “Mr. Big” sting operation to be used in the trial. That evidence includes an admission Fertuck made to an undercover officer posing as a member of a criminal organization that he shot his estranged wife twice near a gravel pit, killing her.
Sheree’s remains have never been found.
Outside the courtroom, Crown prosecutor Carla Dewar said she had been waiting a while for this decision.
“We’ve had various issues arise to provide the decision, so finally it came today,” said Dewar.
“What we were waiting to hear about is that the admissions made during that (sting) are going to be admissible as evidence against Mr. Fertuck.”
Dewar said she hopes the decision will get the trial back on track and that there won’t be any more major delays.
“The families of Mrs. Fertuck have been waiting for, obviously, a substantial period of time for matters to get to where we are even today,” said Dewar.
“I think everyone’s very happy that we have finally concluded this portion of things, and hopefully the next part of the trial will not take nearly as long.”
Teaka White, Sheree Fertuck’s sister, said she was relieved.
“I was confident that the judge would make the right decision, and he did. So good day for all of us,” said White.
Fertuck said he plans to call a firearm and ammunition expert as a witness in his defence.
White said that doesn’t bother her.
“Probably grasping at straws, like he has been,” said White.
The next court date has been scheduled for Oct. 4.
